To have a great in depth of the topic: “Strengthening the foundations of justice” one has to understand the concept of justice.
Justice, at its core, entails treating individuals equitably and impartially, regardless of their background, social status, or personal beliefs. It is simply the embodiment of fairness and integrity, promoting equal opportunities and ensuring that every person has access to their basic human rights.
Justice means giving each person what he or she deserves or, in more traditional terms, giving each person his or her due.
Strengthening the foundation of justice however involves promoting peaceful and inclusive societies, providing access to justice for all and building effective, accountable and inclusive institutions at all levels. People everywhere should be free of fear from all forms of violence and feel safe as they go about their lives whatever their ethnicity, faith or sexual orientation. By that they are able to deliver what people expect of them. To however ensure the strength of Justice is sustained, the role of the Judiciary cannot be overemphasized.
In order to protect the role of the judiciary as one of the essential pillars of the modern democratic state, it must be ensured that the three powers are independent and complementary to each other with no pillar dominating the others. The complementarity of this system is based on a relationship of interdependence, where each pillar has its own independent function but is subject to the system of checks and balances that holds each pillar accountable. A certain level of tension between the three powers may therefore be a sign of a well-functioning system, showing that each power is providing the necessary check on the other powers. However, the equilibrium between the three powers of a state is delicate and can easily be disrupted. This has been the case in some states where incidents have been reported of excessive interference of the executive and legislative in the functioning of the judiciary. Such interferences greatly undermine the independence of the judiciary, without which it cannot fulfil its role as an impartial adjudicator between members of society and the state and between members of society themselves.


It must be kept in mind that it is by protecting the role of the judiciary and ensuring its independence that we can protect the essential rights of all citizens, especially those groups that are particularly vulnerable or unpopular in society. It is also by ensuring the independence of the judiciary that we can safeguard the rule of law, without which there can be no respect for democracy or human rights.

I must say that what I feel is the biggest challenge for us, is not just to create forums and to create laws that give us the stepping stone into the world of access to justice, but to see that the whole concept of access to justice expands to social justice, where people have access to social justice and that social justice is as important as legal justice.

We as human right defenders are not just lawyers; we are social activists in many ways. Of course, we always have to choose the forum. We have to choose between the courts and the streets, and as lawyers we have been in both the streets and the courts and won many victories. The challenge for us now, is to make sure that the mechanisms that we have been able to create start functioning and functions in a manner in which equality, fairness and justice is judiciously served to all.
